 Evogenom Oy is a Finnish biotechnology company focused on enhancing health and well-being through genetics. We are committed to ethical, reliable, and scientifically rigorous services. Confidentiality, privacy, and equal treatment are guiding principles in everything we do.

Our genetic reports are based on scientifically researched data, and every section is supported by a research reference. Because science evolves, findings may be updated as new research emerges. Our service does not provide medical diagnoses, but helps you understand your DNA, your strengths, and your traits.

The purpose of these Terms is to set out clearly how our service works, your rights, and our responsibilities.

1. Introduction

These Terms & Conditions (“Terms”) form a binding contract between you (“Customer”) and Evogenom Oy (“Evogenom”, “we”, “us”). By placing an order through our website or using our services, you agree to these Terms.

2. Eligibility

  • You must be at least 18 years old.
  • You may only provide your own saliva sample.

3. Scope of Service

  • Evogenom provides informational DNA testing services, wellness reports, and access to our mobile app and EvoCoach AI.
  • Our services are for informational and wellness purposes only. They are not medical advice, diagnosis, or treatment, and do not replace consultation with a healthcare professional.

4. Orders and Delivery

  • First orders are placed through our webshop. Prices include applicable VAT unless otherwise stated.
  • Delivery times are estimates; we are not liable for delays caused by carriers or customs.
    Risk of loss passes to you once the kit is delivered.
  • Any new test results can be bought in the App and will be available instantly 

5. Additional Analysis & Add-On Reports

  • Customers who have already purchased and registered a DNA testing kit may choose to unlock additional trait reports or analyses based on their existing genetic data.
  • These add-on reports are extensions of the original laboratory service and are directly linked to the physical saliva sample you have already provided.
  • Once purchased, the analysis is carried out using your existing genetic dataset and the reports are made available to you in the app.
  • Because these add-on services are delivered immediately and rely on your previously submitted sample, your statutory right of withdrawal does not apply once the service has been unlocked.
  • Prices and payment options for add-on reports are displayed in the app before purchase.

6. Right of Withdrawal & Refunds (EU Consumers)

  • You may cancel your order within 14 days of delivery if the kit is unopened.
  • Once you register the kit or provide a sample, the service has begun at your request, and your right of withdrawal may be limited.
    Refunds for valid cancellations will be issued within 14 days after we receive the returned, unopened kit. Return instructions are available from our support team.

7. Sample Processing & Re-collection

  • If the laboratory cannot process your sample (e.g., insufficient DNA), we will provide one replacement kit free of charge.
  • If a second sample also fails due to reasons outside our control, we may offer a partial refund (minus shipping/handling).

8. Results & Interpretation

  • Reports are typically delivered through our app within the estimated timeframe, but delivery times are not guaranteed.
  • Genetic science evolves; reports may be updated over time.

9. EvoCoach Subscription 

  • We may offer EvoCoach or other services on a subscription basis. Unless cancelled before renewal, subscriptions renew automatically each billing period.
  • You can cancel anytime in the app 
  • Fees are non-refundable for partially used periods, except where required by law.
  • We will notify you of price changes in advance, and you may cancel before changes take effect.

10. Acceptable Use & Intellectual Property

  • You may use our reports and app for personal purposes only.
  • All intellectual property in our content, software, and brand remains with Evogenom.
  • You may not reverse-engineer, resell, or misuse the services. 

11. Limitation of Liability

  • To the maximum extent permitted by law, Evogenom’s total liability for any claims shall not exceed the amount you paid for the service giving rise to the claim.
  • Nothing limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded by law.

12. Privacy Policy

  • By accepting these Terms of Service, you also acknowledge that you have read, understood, and accept our Privacy Policy, which explains how we collect, use, and protect your personal data.

13. Governing Law & Disputes

  • These Terms are governed by Finnish law.
  • If you are an EU consumer, you may also bring claims in your local courts. Otherwise, disputes shall be resolved in the District Court of Helsinki, Finland.

14. Changes to Terms

We may update these Terms to reflect changes in our services, laws, or business practices. Updates will take effect once posted on our website.
